Terms of Use
These Terms of Use (“Terms”) constitute a binding agreement between you and AIW (“AIW,” “we,” “us,” or “our”) governing access to and use of amiwrong.net, the AIW mobile applications, and related offerings (collectively, the “Services”). They are drafted to meet common distribution and review expectations of the Apple App Store and Google Play, including disclosures for auto‑renewing subscriptions. Our Privacy Policy explains how we collect and use personal information. Our Community Guidelines describe rules for discussion and user content. For a concise subscription & billing summary (trial, price, cancel, refunds), see Subscriptions & in‑app purchases.
Agreement & eligibility
- By accessing or using the Services after the effective date below, you agree to these Terms.
- If you are under the minimum age required in your country to consent to data processing or to use our Services without parental permission, you must not use the Services except as permitted by governing law and with any required parental oversight and device restriction (for example Apple/Google family tools).
- Paid mobile features may require you to be of legal age to contract where you live. If you lack capacity, a parent/guardian must complete purchases and supervise use.
- We may modify the Services or these Terms; continued use after posting changes means acceptance where law allows. Material subscription changes will be described as required by storefront rules.
Accounts & credentials
- You may sign in with Google to access a web dashboard and to receive mobile playback credentials (username/password issued by us).
- Keep passwords secret; you are responsible for activity under your credentials until you notify us of compromise.
- Provide accurate registration information required for security and legal compliance.
- We may suspend or terminate accounts for breach, risk, investigations, fraud, unlawful activity, or platform policy breaches.
License to use
Subject to these Terms we grant you a limited, worldwide, revocable, non‑exclusive, non‑transferable licence to install and/or access the portions of the Services made available to you for personal non‑commercial use except where monetization features are expressly allowed.
You must not reproduce, scrape, circumvent technical controls, automate abusive access, decompile/source‑derive software except permitted by statute, misuse APIs, interfere with peers, exploit bugs for gain, violate export laws.
User content & licence to AIW
You retain ownership rights in content you post. By posting you grant AIW an irrevocable (while hosted) perpetual worldwide licence to reproduce, publicly display, modify for format/moderation, distribute, excerpt, summarise, annotate, subtitle, monetise editorially/advertiser contexts (subject to advertiser policies), and create derivative compilations purely for showcasing within the Services and marketing materials referencing on‑platform activity.
You represent you possess necessary rights, your content complies with laws, isn't defamatory beyond fair opinion, excludes illegal material, and doesn't infringe third parties.
Copyright — DMCA & repeat infringer policy
We respect intellectual property. If you believe content infringes your copyright, email contact@amiwrong.net with: (1) identification of work, (2) URL or description of allegedly infringing material, (3) your contact details, (4) good‑faith statement of unauthorized use, (5) statement under penalty of perjury that your notice is accurate and you are authorized to act. We may remove or disable access and notify the poster; counter‑notices may be processed consistent with the DMCA where applicable. We may terminate repeat infringers.
Prohibited conduct
In addition to our Community Guidelines, you must not:
- Harass, threaten, doxx, stalk, impersonate, or encourage self‑harm or violence;
- Post CSAM, exploitative content, malware, or instructions for serious crimes;
- Circumvent payment/entitlement, share accounts to evade purchase, or use stolen payment methods;
- Spam, bot‑post, manipulate metrics, or mislead users;
- Violate applicable export, sanctions, copyright, privacy, or age‑appropriate safety laws.
Moderation
We may remove, restrict, label, or demote content; freeze features; or ban accounts to protect community safety, comply with law, respond to platform demands, or enforce these Terms. Some decisions are automated or assisted; human review may follow.
Apple App Store — additional terms (iOS)
If you obtain the app from Apple’s App Store, you acknowledge: (a) these Terms are between you and AIW only, not Apple; (b) Apple has no obligation to furnish maintenance or support for the app; (c) Apple is not responsible for the app or its content; (d) Apple’s Standard Licensed Application End User License Agreement (Apple Standard EULA) also applies to the extent not inconsistent with these Terms; (e) Apple and its subsidiaries are third‑party beneficiaries of these Terms solely to enforce their rights under the EULA against you; (f) you must comply with applicable third‑party terms when using the app.
Google Play — additional terms (Android)
If you obtain the app from Google Play, you agree to Google’s applicable terms, including the Google Play Terms of Service for device distribution and billing. Google is not responsible for the app or AIW support obligations except as expressly required by applicable law or policy.
Auto‑renewing subscriptions (required storefront disclosures)
A plain‑language summary for shoppers and reviewers (including current US price and trial length) is on our Subscriptions & in‑app purchases page. The following legal disclosures remain part of these Terms.
AIW may offer an auto‑renewing subscription for mobile audio access (for example a monthly plan and, where offered, a free trial). The current price, currency, length, and trial terms are displayed in the purchase flow in the applicable storefront at checkout and may vary by region or taxes.
- Payment: Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase (or after any free trial ends if you did not cancel in time according to storefront rules).
- Auto‑renewal: Subscription automatically renews for the same term unless auto‑renew is turned off in your Apple or Google subscription settings at least 24 hours before the end of the current period.
- Manage / cancel:
- Apple: Settings > [your name] > Subscriptions (path may vary by OS version).
- Google Play: Payments & subscriptions > Subscriptions in the Play Store app or from your Google account.
- Cancellation timing: If you cancel, you generally retain paid access until the end of your current prepaid period unless the storefront policy states differently.
- Price changes: If the price of a subscription increases, applicable storefront rules govern notice and your right to accept or cancel.
- Free trial: If a trial is offered, unused trial time may be forfeited when you purchase a subscription, as disclosed in the purchase sheet and per platform policy.
- Refunds: Refund requests are handled solely by Apple or Google according to their policies — see Disclaimer and the “Refunds” section below.
Paid features, pricing, taxes
- Digital goods: Purchases are digital subscription entitlements to mobile audio features; no physical goods ship.
- Taxes & FX: Final price may include applicable taxes and currency conversion per storefront.
- Web reading: Unless stated otherwise, reading open web content may remain free and separate from mobile subscription.
Refunds & billing disputes
- In‑app purchases: Apple and Google process payments and decide refund eligibility. AIW cannot issue card refunds for those transactions or override storefront decisions.
- How to request a refund: Use Apple’s “Report a Problem” or Google Play Help refund paths; keep receipts.
- Account help: Email contact@amiwrong.net for credential or entitlement questions — not for processing refunds.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON‑INFRINGEMENT, ACCURACY OF COMMUNITY CONTENT, UNINTERRUPTED SERVICE, OR ERROR‑FREE OPERATION. USER STORIES AND COMMENTS ARE OPINIONS OF USERS, NOT PROFESSIONAL ADVICE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIW AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA/GOODWILL, ARISING FROM THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) U.S. $100 OR (B) THE FEES ACTUALLY PAID BY YOU DIRECTLY TO AIW VIA ALLOWED NON‑IAP PAYMENT CHANNELS SOLELY FOR THE ONLINE SERVICES IN THE PRIOR THREE (3) MONTHS — WHICH EXCLUDES THIRD‑PARTY IN‑APP CHARGES NOT REMITTED TO US. BECAUSE SOME JURISDICTIONS DISALLOW LIMITATIONS, RIGHTS MAY DIFFER LOCALLY AND STATUTORY CONSUMER RIGHTS REMAIN.
Indemnity
To the fullest extent permitted by law, you will defend (at our reasonable request), indemnify, and hold harmless AIW from third‑party claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, misuse of the Services, breach of these Terms, or violation of law.
Termination
You may stop using the Services anytime. We may suspend or terminate access with or without notice for operational, legal, risk, or breach reasons. Provisions that by sense continue (IP, disclaimers, liability limits, indemnity, governing law) survive.
Governing law & disputes
General (non‑EEA/UK consumers): These Terms are governed by the laws of the State of California, USA, excluding conflict‑of‑laws rules. Subject to mandatory consumer protections where you live, exclusive venue for disputes will be the state and federal courts located in Santa Clara County, California, and you consent to personal jurisdiction there.
EEA / UK / Switzerland consumers: Nothing in these Terms limits non‑waivable statutory rights under your local laws. You may bring proceedings in your country of residence. Mandatory EU/UK consumer protection remains unaffected by any forum clauses above where prohibited.
Informal resolution: Before filing suit (where permitted), contact contact@amiwrong.net with a concise dispute summary to attempt good‑faith negotiation for 60 days.
Class‑action waiver (U.S.)
TO THE EXTENT PERMITTED BY LAW AND ONLY FOR CLAIMS BROUGHT INDIVIDUALLY BY RESIDENTS OF THE UNITED STATES SEEKING PRIVATE RELIEF ARISING FROM THESE TERMS EXCEPT INTELLECTUAL PROPERTY CLAIMS BROUGHT SEPARATELY, YOU WAIVE RIGHTS TO BRING CLASS OR REPRESENTATIVE PROCEEDINGS. IF A COMPETENT COURT FINDS THIS WAIVER UNENFORCEABLE, THE SEPARABILITY PROVISION CONTROLS.
Miscellaneous
- Entire agreement: These Terms plus referenced policies/statements form the integrated agreement superseding conflicting prior writings on scope.
- Severability: If a provision is void, remainder stays effective maximally consistent with intent.
- Assignment: We may assign freely; you may not assign.
- Waiver: Failure to enforce isn’t waiver.
- Electronic communications: Notices electronically satisfy writing where allowed.
